Standard terms of business


Sec. 1 Scope of application


The business relationship between Schloß Schönbrunn Kultur- und Betriebsges.m.b.H. (hereinafter referred to as Schönbrunn Palace) and the customer shall be subject exclusively to the following standard terms of business in the version in force at the time of the order. Schönbrunn Palace shall not recognise customer’s terms to the contrary unless it has expressly consented to their application in writing.


Sec. 2 Conclusion of contract


Your order constitutes an offer to us to conclude a purchase contract. If you place an order with Schönbrunn Palace, we will send you an email confirming the receipt of your order and setting out the details (order confirmation). This order confirmation does not constitute an acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded if we send you the product ordered and the dispatch to you is confirmed in a second email (dispatch confirmation). No purchase contract is concluded for products from one and the same order that are not listed in the dispatch confirmation.


A valid purchase contract can only be concluded with persons of full age and full legal capacity.


Please note that all products are only sold in normal household quantities. This relates both to the number of products ordered as part of one order and to the placing of a number of orders for the same product in which the individual orders comprise a usual household quantity.


Sec. 3 Right of withdrawal


You have the right to withdraw from this contract within 14 days without giving any reason.


The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.


To exercise the right of withdrawal, you must inform us (Schloß Schönbrunn Kultur- und Betriebsges.m.b.H., Official Sisi Shop, Schloß Schönbrunn/Kavaliertrakt, 1130 Wien, Österreich, onlineshop@schoenbrunn.at)) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail).


To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.


Effects of withdrawal


If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.


You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.


You will have to bear the direct cost of returning the goods.


You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


Exclusion of withdrawal


There is no right of withdrawal for distance selling contracts


  • for the supply of goods prepared to customer specifications or that are clearly tailormade to personal needs or that by virtue of their nature are not suitable for return or that can spoil quickly or whose expiry date has been exceeded,
  • for the delivery of audio or video recordings or of software, if the data carriers have been unsealed by the consumer, or
  • for the supply of newspapers, journals and magazines


Sec. 4 Delivery


Unless agreed otherwise, delivery shall be ex-Schönbrunn Palace stock to the delivery address specified by the customer. Details concerning delivery period are provided alongside the article in the online shop. We refer to Sec. 2, 1st paragraph of these Standard Terms of Business.


If Schönbrunn Palace is unable to deliver the goods ordered for no fault of its own, Schönbrunn Palace shall be entitled to withdraw from the contract with the customer. In such event, the customer shall be informed without delay that the product ordered is not available.


If a delivery to the customer is not possible because the delivered goods do not fit through the customer’s entrance door, front door or staircase, or because the customer is not present at the delivery address specified by him although the time of delivery has been notified to the customer with reasonable notice, the customer shall bear the costs for the unsuccessful attempt to deliver.


Sec. 5 Prices, due date and payment, default


The prices in the online shop are inclusive of VAT. The specific shipment costs will be stated during the order process (before conclusion of the order confirmation).


The customer can pay the purchase price by credit card. If the customer is in payment default, Schönbrunn Palace shall be entitled to charge default interest at an annual rate of 5% above the base rate of interest announced by the European Central Bank. If Schönbrunn Palace can prove to have suffered a greater loss from the default, it shall be entitled to claim such.


Sec. 6 Offset, retention


The customer shall only be entitled to offset if his counterclaims have been determined with final legal effect or are undisputed by Schönbrunn Palace. Moreover, he shall only be entitled to exercise a right of retention to the extent that his counterclaim is based on the same contractual relationship.


Sec. 7 Reservation of title


The goods supplied will remain the property of Schloss Schönbrunn until paid for in full.


Sec. 8 Liability for defects and complaints


If the purchased object suffers from a defect, the statutory provisions shall apply. The customer shall not be entitled to assign these claims. In the event of complaints, please contact onlineshop@schoenbrunn.at.


Unless the contrary follows from the following, the customer shall have no further claims, on whatever legal ground. Schönbrunn Palace shall therefore not be liable for damage that does not occur to the object delivered itself; in particular, Schönbrunn Palace shall not be liable for lost profits or for other financial losses on the part of the customer. Where Schönbrunn Palace’s contractual liability is excluded or restricted, the same shall also apply to the personal liability of employees, representatives and vicarious agents.


The aforesaid restriction on liability shall not apply where the cause of the loss is due to intent or gross negligence or where there is an injury to persons. Nor shall it apply if the customer asserts claims regulated by statute.


If Schönbrunn Palace infringes an essential contractual obligation with gross negligence or deliberately, the liability to compensate for damage to property shall be restricted to the losses typically occurring.


If supplementary performance is effected by means of the supply of a replacement, the customer shall be obliged to return the goods originally delivered to Schönbrunn Palace within 30 days at Schönbrunn Palace's expense. The return of the faulty goods shall be effected in accordance with the statutory provisions. Schönbrunn Palace reserves the right to claim damages subject to the statutory preconditions.


The expiry period shall be two years starting from the date of delivery.


Sec. 9 Data protection and declaration of consent


1. General


Information that we receive from you helps us to individually arrange and constantly improve your purchase experience at Schönbrunn Palace. We use this information for handling orders, delivering goods, providing services and for handling the payment (in the case of purchases on account, also for the checks necessary). We also use your information in order to communicate with you about orders, products, services and other marketing offers, in order to update our data records, to maintain and update your customer account with us, to map content such as wish lists or customer reviews and to recommend products or services to you that might interest you. We also use your information to improve our shop and our platform, to prevent or identify the misuse of our website, and to permit third parties to carry out technical, logistic or other services on our behalf.


2. Automatic data collection


For technical reasons, the use data that a user’s Internet browser communicates to Schönbrunn Palace includes the following:


  • *)browser type and version;
  • *) operating system used;
  • *) website from which the user visits the www.sisi-shop (referrer URL)
  • *) website that the user visits;
  • *) date and time of access;
  • *) Internet Protocol (IP) address of the user's computer.


The data is stored separately from any communicated user data (in particular name, address, telephone number, email address, language – for details see Subsection 3) and is analysed for statistical purposes in order to optimise the Internet presence and products presented on sisishop.at (see also Subsection 5 of this data protection declaration).


3. Use of data


3.1 The following personal details are requested during order processes:


Name, address, telephone number, email address, language. The personal details communicated in the course of orders are used exclusively for handling the contract; payment information is protected in an encrypted process and only used for handling payments.


3.2 When registration is made for the newsletter and company magazines, the following data is collected:


Name, email, postal address. This data is used exclusively for sending the newsletter/company magazines ordered.


4. Cookies


Schönbrunn Palace uses cookies for the purpose of providing its services. Cookies are small text files that the user's Internet browser deposits and stores on his computer. This allows Schönbrunn Palace to recognise a repeat use of its web material by the same user. Users can prevent the installation of cookies by a corresponding setting in their browser software; however, Schönbrunn Palace points out that in such a case not all functions of the website can be used to the full.


5. Analysis of sisi-shop.at


In order to improve and optimise its web presence, Schönbrunn Palace uses Google Analytics, a web analysis service of Google Inc. (hereinafter Google). Google Analytics uses cookies, text files stored on the user's computer that allow an analysis of the user’s use of the website. The information generated by the cookie about the use of this website is as a rule sent to a Google server in the USA where it is stored. Schönbrunn Palace has activated “_anonymizeIp()” for its websites; with this extension, IP addresses are truncated before being processed in order to exclude the possibility of a direct reference to persons. The anonymizing of the IP on this website means that the IP address of a Google user within the member states of the European Union or in other member states of the Agreement on the European Economic Area are first truncated. It is only in exceptional cases that the full IP address is transferred to a Google server in the USA and truncated there. In the course of the application of Google Analytics to information obtained at sisi-shop.at, Google is used as a service provider for Schönbrunn Palace in order to analyse the use of the website, to compile reports on web activities and in order to provide other services associated with the use of the website and the Internet for Schönbrunn Palace. The IP address communicated by a user's browser within the framework of Google Analytics is not associated with other Google data. By using the sisi.shop.at website, the user confirms his agreement to the use of the data obtained about him in the manner described above and for the aforementioned purpose. Users can prevent the storing of cookies by a corresponding setting on their browser software; however, we point out that in such a case the user may not be able to use all the functions of this website in full. In addition, users can prevent the recording of the data generated by the cookie and relating to the use of the website (including the IP address), their transmission to Google as service provider and the processing of this data by Google by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

Declaration of consent for the use of www.sisi-shop.at


I have read the Schönbrunn Palace data declaration and in the light of this data protection declaration issue the following consent:


1. I consent to my IP address and my log files (data concerning the use of the sisi-shop.at website) being used for a statistical analysis of Schönbrunn Palace's Internet presence. For this purpose, Schönbrunn Palace makes use of Google Analytics, which means that IP addresses and log files of my visits to the sisi-shop.at site will be sent to Google Inc as service provider for the purpose of analysing the use of the sisi-shop.at site. The extension “_anonymizeIp()” anonymizes my IP address, which is then no longer directly person-related. I note that I have the possibility of preventing the storage of cookies by a corresponding setting in my browser software, although as a result I might not be able to use all functions of the website in full. In addition, I note that that I can deactivate Google Analytics for me by installing a browser add-on (available at http://tools.google.com/dlpage/gaoptout?hl=de), and there can thereby revoke my consent to the use of Google Analytics.


2. I note that I can revoke this declaration of consent in whole or in full at any time by carrying out the procedure set out in Paragraph 1.


Sec. 10 Applicable law


Austrian law shall apply to the exclusion of the UN law on the sale of goods (CISG). The legal venue shall be the court competent for such cases at Vienna, Inner City.
